This summary highlights the clauses that limit liability (Brazilian Consumer Protection Code, art. 54, §4). It does not replace the full text below, which is what binds the parties.

1. Parties and acceptance

1.1. These Terms govern the use of Whit (“Whit”, “we”), provided by JParizotto Technology LTDA, Brazilian company registration (CNPJ) No. 55.618.423/0001-61, headquartered at Avenida Paulista, 1106, Sala 01 / Andar 16, Bela Vista, São Paulo/SP, CEP 01310-914, Brazil, on the website whit.dental and through messaging channels such as WhatsApp.

1.2. The parties are Whit and the person who accesses or uses the service (“User”, “you”).

1.3. Acceptance occurs when you click to accept, create an account, start a trial, send a message to Whit or use the service through any channel. If you do not agree, do not use Whit.

1.4. These Terms are complemented by the Privacy Policy.

2. Definitions

3. Purpose and nature of the service

3.1. Whit is an artificial intelligence–based tool for informational support, study and clinical reasoning, which helps dentists and students organize information and consult scientific evidence.

3.2. Whit does not constitute, does not replace and must not be construed as: (a) the provision of dental services; (b) a consultation, diagnosis, prescription, clinical report, opinion or prescription form; (c) a health product or medical device; (d) a substitute for clinical examination, medical history or complementary tests; (e) a formal professional second opinion; (f) an emergency service.

3.3. Whit does not perform acts reserved to dentists, which are restricted to qualified professionals under Brazilian Law No. 5,081/1966 and the rules of the Federal Council of Dentistry (CFO).

3.4. Using Whit does not create a relationship of dental service provision, a clinical duty of care or technical responsibility between Whit and you, your patients or third parties.

3.5. Whit is not an emergency channel. In an emergency, seek in-person care immediately. We do not monitor use in real time.

3.6. Whit follows the “Human-in-Command” principle: the AI suggests, the professional decides.

4. Limitations inherent to artificial intelligence

4.1. Whit operates with language models that have intrinsic limitations, described here, which do not constitute a flaw or defect of the service.

4.2. Probabilistic nature. Outputs are generated by statistical inference. The same question may produce different answers, and the apparent confidence of the text does not indicate that it is correct.

4.3. Errors and hallucination. Whit may generate incorrect, incomplete, outdated or non-existent information, including references, authors, studies, figures and protocols that look real.

4.4. Source of the answer. Whit consults a selected literature base and, when a topic is not covered there, may answer using the model’s general knowledge. Citing a source does not guarantee that the evidence is current or that it applies to your case, and the absence of a citation indicates that the answer was not based on a reference from the base. It is up to you to assess clinical relevance.

4.5. Mandatory verification. Information on drugs, doses, dosage regimens, concentrations, routes, intervals, contraindications, drug interactions, anesthetics and therapeutic approaches must be checked by you against an official, up-to-date source (package insert, ANVISA, recognized literature or a specialist) before any application. Whit is not an official source for these purposes.

4.6. Images and tests. When you send photos, radiographs or other tests, Whit’s interpretation is only a suggestion and is subject to error. Analysis and diagnosis always belong to the responsible professional, who must evaluate the original test.

4.7. Whit does not guarantee that it has considered all relevant hypotheses, differential diagnoses, contraindications or sources.

4.8. By using Whit, you declare that you are aware of these limitations and accept them as characteristics of the technology.

5. The user’s technical and professional responsibility

5.1. This clause is an essential condition of these Terms.

5.2. Ownership of the decision. Every diagnostic, therapeutic, surgical, prognostic or management decision always and exclusively belongs to the responsible dentist, based on clinical examination, medical history, tests and their professional judgment.

5.3. Non-delegability. The dentist’s technical responsibility is personal and cannot be delegated, under the laws governing the profession and the Brazilian Code of Dental Ethics. It is not transferred to Whit, its partners, employees or service providers by the mere use of the platform.

5.4. Duty to verify. You must critically review every Output before using it and must not apply, prescribe or recommend any approach based exclusively on a Whit Output.

5.5. Documents. You may not present a Whit Output as your own clinical report, opinion, certificate, prescription or technical document without reviewing it in full and assuming the corresponding technical responsibility.

5.6. Student User. If you are a student, use is exclusively educational. You may not use Whit to advise, diagnose, prescribe for or treat patients, even free of charge or during an internship, except under the direct supervision and responsibility of a qualified dentist, as provided by law.

5.7. Transparency with the patient. It is up to you to follow your Council’s rules on informing the patient, recording in the patient chart and keeping clinical documentation.

6. Registration, account and access

6.1. Provide truthful information and keep it up to date.

6.2. The account and the registered WhatsApp number are personal and non-transferable. Sharing access, reselling or allowing use by a third party, including another professional at the same clinic, is prohibited, unless your plan expressly allows multiple users.

6.3. You are responsible for keeping your credentials confidential and for what happens on your account or number, except for failures attributable exclusively to Whit. Notify us immediately of any unauthorized use.

6.4. Whit may require proof of CRO registration or of enrollment in a dental program for certain features.

6.5. Whit is not intended for persons under 18.

7. Plans, prices and payment

7.1. Whit may be offered free of charge or by subscription, under plans, prices and conditions that will be clearly disclosed before any purchase.

7.2. No charge will be made without your express acceptance.

7.3. When charges begin, the conditions (price, cycle, renewal, payment method and cancellation) will be disclosed before purchase and will comply with the Brazilian Consumer Protection Code, including the 7-day right of withdrawal (art. 49) and 30 days’ prior notice of any price change.

8. License and intellectual property

8.1. Whit grants you a personal, limited, revocable, non-exclusive and non-transferable license of use for as long as your access lasts.

8.2. Software, code, architecture, databases, interfaces, the brand (Whit), visual identity, domains and documentation belong to Whit or its licensors. Nothing here transfers these rights.

8.3. You may not copy, modify, distribute, commercialize, reverse engineer or systematically extract content from the platform by automated means, including to train a competing AI model.

8.4. Knowledge base. The scientific literature and works consulted belong to their respective owners. Whit presents its own summaries and references and grants no license over third-party works. Citations and links are provided so you can consult the source.

8.5. To the extent permitted by law, Whit does not claim ownership of the Outputs generated from your content, which you may use professionally, subject to clauses 4 and 5. Outputs are not necessarily unique, and Whit does not guarantee originality or copyright protection.

9. User content

9.1. You are responsible for User Content and declare that you hold the rights and legal bases needed to send it.

9.2. You grant Whit a free, non-exclusive and limited license to store, process, transmit and display the content, solely to operate the service, ensure security and comply with legal obligations.

9.3. Patient data. Describe cases in de-identified form. Do not send the patient’s name, CPF (Brazilian taxpayer ID), contact details, address, facial photo or other information that identifies them, nor personal data beyond what is strictly necessary. If you enter identifiable data, you, as controller, are responsible for the legal basis and for the duty to inform the patient.

9.4. You may not send unlawful or offensive content, content that violates third-party rights, or malicious code.

9.5. No training. Whit does not use User Content to train AI models, whether its own or third parties’. See the Privacy Policy, section 4.

9.6. We may perform statistical analyses with aggregated and anonymized data from which neither you, your patients nor any other data subject can be identified.

9.7. Recordings and audio. If you send audio or recordings containing third parties’ voices, you are responsible for obtaining the necessary consent.

10. Prohibited conduct

11. Data protection

11.1. The processing of personal data follows the LGPD and the Privacy Policy, which explains roles (controller/processor), legal bases, sharing, international transfer, retention and rights.

11.2. Data protection officer / privacy channel: privacy@whit.dental.

11.3. Whit treats the content you send as confidential and shares it only with the service providers needed for operation, under confidentiality and security obligations, or when required by law. No system is absolutely secure: the obligation is one of means.

12. Availability and evolution

12.1. Whit seeks to keep the service available but does not guarantee uninterrupted availability or the absence of errors. It may be unavailable due to maintenance, failure of third parties on which it depends (infrastructure, AI models, WhatsApp) or force majeure.

12.2. We may change, add or discontinue features, with reasonable prior notice when the change is relevant.

12.3. Support is provided at hello@whit.dental on business days. We try to respond as quickly as possible, but do not guarantee a specific response time.

13. Disclaimer of warranties

Except for non-waivable statutory warranties, the service is provided “as is”. Whit does not warrant that it will produce correct, complete or up-to-date Output, that it will achieve any specific result or that it will be free of failures. No guidance obtained through the platform creates any warranty not provided for in these Terms. Whit does not validate the content of cited third-party sources.

14. Limitation of liability

14.1. Read together with clauses 3, 4 and 5.

14.2. Clinical decisions. Whit is not liable for any clinical, diagnostic, therapeutic or management decision made by you or a third party, even with the support of a platform Output, nor for its results on patients, on your professional activity or on third parties.

14.3. Use of Outputs. Whit is not liable for damages arising from the use of an Output without the verification required by clauses 4.5 and 5.4, from use in breach of these Terms, or outside the purpose of informational support.

14.4. To the maximum extent permitted by law, Whit is not liable for indirect damages, lost profits, loss of opportunity, clientele or data, reputational damage or punitive damages.

14.5. To the maximum extent permitted by law, and except in the case of willful misconduct or gross negligence by Whit, Whit’s total liability to the User for any claim arising from the use of the Service is limited to the amount actually paid by the User to Whit in the 12 (twelve) months preceding the event giving rise to the claim or, if nothing was paid in that period, to the equivalent of one monthly fee of the lowest-priced plan then in effect. This limit does not affect non-waivable rights under the Brazilian Consumer Protection Code or liability that the law does not allow to be limited.

14.6. Whit is not liable for failures, delays, policy changes or discontinuation of third-party services on which it depends (infrastructure, AI providers, WhatsApp/Meta), nor for failures of your equipment or connection.

14.7. Legal reservation. Nothing here excludes or limits liability for willful misconduct, gross negligence, violation of personality rights or other cases in which the law does not allow limitation. In consumer relationships, the limitations apply only to the extent permitted by the Consumer Protection Code.

15. Suspension and termination

15.1. You may stop using Whit and ask for your account to be closed at any time, at hello@whit.dental or through the support channels.

15.2. Whit may suspend access in the event of well-founded evidence of a breach of these Terms, a security risk, suspected fraud or an order from an authority, stating the reason whenever possible and allowing you to contest it, unless prohibited by law.

15.3. If the service is discontinued, we will give reasonable advance notice and, if there are amounts paid and not used, we will issue a proportional refund.

15.4. After termination, your data will be processed and deleted in accordance with the Privacy Policy. You may request a copy of your data through the privacy channel, under the LGPD.

16. Changes to these Terms

We may change these Terms to reflect legal changes, the evolution of the platform or improvements in wording. The current version is on this page, with its date. Changes that restrict rights or expand obligations will be communicated at least 30 days in advance through the contact channels. Continuing to use the service after they take effect implies acceptance; if you do not agree, stop using it.

17. General provisions

These Terms and the policies referred to form the entire agreement. Tolerance of a breach does not imply waiver. The invalidity of one clause does not affect the others. You may not assign these Terms without written consent; Whit may assign them in a corporate reorganization, with notice. Neither party is liable for acts of God or force majeure.

18. Governing law and jurisdiction

18.1. Brazilian law applies, in particular the LGPD and, where applicable, the Consumer Protection Code.

18.2. The courts of the city of São Paulo, State of São Paulo, Brazil, are chosen as the venue, without prejudice to the consumer’s right to bring an action in the courts of their place of residence.
